Terms and conditions for the use of the spectrumtherapeutics.pl website


Dear User,

in this document you will find a number of rules and information relating to your use of Our website available at spectrumtherapeutics.pl (the ‘Portal’).


Basic information

The owner of the Portal is Canopy Growth Polska Sp. z o.o. in Toruń (87-100) at ul. Grudziądzka 1-3 (KRS 0000470617, NIP 9512445224, REGON 146784244).

Contact with Canopy Growth Polska Sp. z o.o. (‘Company’) can be contacted in two ways:

- traditional - by sending a letter to the Company's address indicated above or

- electronically - by sending an e-mail to pl.info@canopygrowth.com or by using the contact form available on the subpage of the Portal (https://www.spectrumtherapeutics.pl/pages/contact-us).


Terms of use

This document (‘Terms of Use’) sets out the conditions for the provision of services electronically through the Portal and is available permanently and free of charge on the relevant subpages of the Portal. Each person who uses the Portal (‘User’) may download, save, open or print these Rules at any time. By using the Portal, the User agrees to the provisions of the Regulations.

The Portal is available to Users who are at least 18 years of age and have full legal capacity. 

Subject to possible malfunctions, the Portal is available 24 hours a day, 7 days a week.

In order to use the Portal, it is necessary for the User to have a device with access to the Internet (this may be a computer, tablet or smartphone) with a web browser installed. The User intending to use the contact form provided should still have an active e-mail address to which a reply will be sent by the Company.

When using the Portal it is prohibited to:

- to provide and transmit content prohibited by law, e.g. content that promotes violence, is defamatory or infringes the personal rights and other rights of third parties, 

- to use the Portal in a way that interferes with its functioning, in particular with the use of specific software or devices, 

- to undertake actions such as sending, via or posting on the Portal, unsolicited commercial information (spam),

- use the Portal in a manner inconveniencing other Users and the Company or its representatives, 

- violate any intellectual property rights of the Company, 

- use the Portal in a manner inconsistent with the provisions of the law in force in the Republic of Poland, the provisions of the Rules of Procedure, as well as with the good practices of Internet use. 

Using any service provided electronically (online), which also applies to the use of the Portal, may involve the risk that unauthorized third parties may gain access to the User's computer system without his/her consent or knowledge. In the case of the Portal, this risk is the same as for other such activities on the Internet. In order to minimise this risk, the User should take care of the protection of his/her system on his/her own by taking appropriate steps (e.g. by installing anti-virus and anti-malware software) and by following the basic rules of Internet browsing. The Company undertakes to use only such applications and programs on the Portal that ensure an adequate level of data protection.

Intangible rights

All materials and content made available or published on the Portal, regardless of their form, including in particular such as text, graphics, logos, icons, images, photographs, audio files, video files and audio-video files, are protected by copyright held by the Company or other entities. 

The reproduction or distribution, in whole or in part, of the material and content referred to above, in any form or by any means, without the prior express consent of the Company or the entity holding the rights to the material, is prohibited, unless such reproduction or distribution is permitted by applicable law. 

The use of the Portal by the User does not result in the transfer by the Company to that User of any rights, including ownership, in the material and content provided. 

Presented goods

The information presented on the Portal, including the various strains of medical cannabis and their contribution to the treatment of various diseases, is general information only and must not be considered as medical advice. This information cannot replace the need to consult the relevant doctor, who ultimately decides on the treatment and therapy to be used. Nor does the information provided constitute advertising of the goods presented.

Complaint procedure

A User who is dissatisfied with the way the Portal works may file a complaint using one of the available forms of contact with the Company. 

Notifications and complaints should include a description of the situation or problem and the User's contact details in the form of their first name, surname and contact address.

The Company will respond to the complaint within 14 days of its receipt at the contact address provided by the User. 

Personal data

The Company is the administrator of the User's personal data. Detailed provisions determining the scope and manner of processing of his/her personal data by the Company are contained in a separate document - Privacy Policy (https://www.spectrumtherapeutics.pl/pages/privacy-policy).

Out-of-court dispute resolution

A User who is a consumer within the meaning of the provision of Article 221 of the Civil Code or an entrepreneur in accordance with Article 431 of the Civil Code, if the provisions of law grant the entrepreneur the rights vested in the consumer, has, inter alia, the following possibilities to use out-of-court ways of dealing with complaints and pursuing claims: 

- is entitled to apply to a permanent amicable consumer court operating at the Trade Inspection to resolve a dispute arising from the concluded Agreement; 

- is entitled to apply to the regional inspector of the Trade Inspection with a request to initiate mediation proceedings for the amicable settlement of a dispute between the User and the Company; 

- may obtain free-of-charge assistance in resolving a dispute between the User and the Company, using also the free-of-charge assistance of a district (city) consumer ombudsman or a social organisation, the statutory tasks of which include protection of consumers (e.g. Federation of Consumers, Association of Polish Consumers). Advice is provided by the Federation of Consumers at the toll-free consumer helpline number 800 007 707 and by the Association of Polish Consumers at the email address porady@dlakonsumentow.pl; 

- submit your complaint via the EU online ODR platform, available at: http://ec.europa.eu/consumers/odr/. 


Final provisions

In matters not regulated herein, the provisions of generally applicable Polish law shall apply. 

The Rules and Regulations shall enter into force upon their announcement by the Company. The Company reserves the right to amend the Regulations at any time. The Company will inform the Users about changes to the Rules and Regulations via the Portal.
